Consistent trademark usage enhances recognition, streamlines operation, ensures legal protection and signals our commitment to excellence. Our trademarks are valuable assets that set us apart from competitors.

As noted by the United States Patent and Trademark Office, a trademark can be any word, phrase, symbol, design, or a combination of these things that identifies your goods or services. Filing with the trademark office aids in protecting a brand’s intellectual property and ensures that others do not use a similar trademark in a way that could cause confusion among consumers. It offers legal recourse to enforce these exclusive rights in the event of trademark infringement.

Big Idea

Always use proper trademark symbols consistently and accurately in all cases. 

 

Do not modify, alter or misuse trademarks. 

DOs

  • Do use appropriate trademark symbols (such as ®,SM, ™).
    While it doesn’t need to be prominently displayed, our consistent usage signifies our intent. This requirement extends to all apparel and promotional items. Utilize superscript whenever the platform allows.
  • Do use trademarks consistently and accurately, respecting the designated spelling, capitalization and styling.
  • Do provide proper attribution or acknowledgment when using third-party trademarks or logos.
  • Do obtain necessary permissions or licenses when using trademarks that are not owned by McCarthy.

DON’Ts

  • Don’t use trademarks in a way that suggests endorsement or affiliation without proper authorization.
  • Don’t modify or alter trademarks, including changing their colors, proportions or design elements.
  • Don’t use trademarks in a generic or descriptive manner that changes their distinctiveness or weakens their legal protection.
  • Don’t use trademarks as part of domain names or on social media without proper permission or authorization, which can be obtained through Corporate Marketing Communications.
  • Don’t use trademarks in a misleading or deceptive manner that might confuse consumers.
  • Don’t use trademarks in a way that tarnishes or undermines their reputation or goodwill.
  • Don’t use trademarks in a manner that violates any applicable trademark laws or regulations.
  • Don’t use trademarks of other companies or organizations without obtaining the necessary permissions or licenses.

DOs:

  • Do use registration mark in the first instance and ALL CAPS.
  • Do superscript the trademark symbol (when platform allows).
  • Do use the appropriate ®, SM or ™ symbol and the accompanying description once, the first time the word mark appears in the text of that particular page/material.

Filed Design Marks

Additional marks can be referenced in the holding company’s standards.

File design marks are specific to McCarthy Building Companies, Inc. (McCarthy) and should not be used to represent any other entities, companies or groups.
